1 Scope

NB/T 10999-2022 is the Chinese specification for the bill of quantities and its valuation in offshore wind power projects, and at 282 pages it is essentially the commercial rulebook for how such a project is tendered, priced and paid for. It exists because offshore wind construction is priced in a way onshore construction is not. The dominant cost is not material or labour but the vessel: an installation jack-up costs a fortune a day whether it is working or sitting out a storm, and a contract that does not say clearly who carries the weather risk, how a delay is measured and what triggers a price adjustment is a contract that ends in arbitration. This document supplies the common language that prevents that. It defines the eleven commercial terms the parties argue over - the bill of quantities and the priced bill, the all-in unit rate, work sections and trades, preliminaries, provisional sum, prime cost sum, dayworks, main contractor's attendance, health safety and environmental provisions, and unit rate project - and its definition of the all-in unit rate is significant because it names the construction vessel explicitly as a cost element alongside labour and materials, which is where offshore diverges from the national code GB 50500 it otherwise follows. It then sets out the preparation of the bill of quantities, with separate lists for work sections and trades, for the purchase of equipment and installation materials, for preliminaries and for other items, together with the item coding scheme; and the valuation clause, which covers the maximum tender price limit, the tender price, the agreement of the contract price, the measurement of the works, the adjustment of the contract price, interim payment, final account and payment, settlement on termination, the handling of valuation disputes, and the archiving of valuation records. The bulk of the document is its twelve annexes: four normative ones giving the items and calculation rules for the building works, the installation works, the equipment and materials purchase list and the preliminaries, plus the format of the bill itself; and seven informative tender item lists covering the wind farm, the offshore substation, the landfall cable, the onshore substation or centralised control centre, other works, the purchase of equipment and materials, and the preliminaries. It was issued on 4 November 2022 by the National Energy Administration and took effect on 4 March 2023.

This document establishes the requirements for the preparation and the valuation of the bill of quantities of offshore wind power projects, and specifies the format of the bill of quantities and the format of its valuation.

This document applies to valuation activities during the tendering, contracting and contract performance of offshore wind power projects.

3 Terms and definitions

3.1 bills of quantities

The detailed list setting out the names and the corresponding quantities of the work section and trade items, the preliminaries, the other items, and the equipment and installation materials purchase items of a construction project. [GB 50500-2013, definition 2.0.1, modified]

3.2 priced bills of quantities

The bill of quantities forming part of the contract documents, in which prices have been entered in the tender, arithmetical errors have been corrected if any, and which has been confirmed by the contractor, including its explanatory notes and tables. [GB 50500-2013, definition 2.0.3]

3.3 all-in unit rate

The labour cost, material cost, construction vessel or plant cost, other direct costs, indirect costs, profit and tax required to complete one specified unit of measurement of an item in the bill of quantities, taking account also of the risk costs to be borne by the contractor. 3.4 work sections and trades

A work section is a component of a single or unit project, obtained by dividing the single or unit project into several sections according to structural location, construction characteristics or construction task; a trade item is a component of a work section, obtained by dividing the work section into several items according to different construction methods, materials or processes. 3.5 preliminaries

Non-physical items arising in construction preparation and in the construction process, relating to construction technique, safety, environmental protection and the like, which are not included in the all-in unit rate. [GB 50500-2013, definition 2.0.5, modified]

3.6 provisional sum

A sum provisionally fixed by the employer in the bill of quantities and included in the contract price, to be used for items not yet determined or not foreseeable at the time the contract is signed, such as the adjustment of the contract price when variations or agreed adjustment factors occur during construction, and claims and site confirmations. 3.7 prime cost sum

The amount provided by the employer in the bill of quantities to pay for items or specialist works that will certainly arise but whose price cannot yet be determined. [GB 50500-2013, definition 2.0.19, modified]

3.8 dayworks

A method of valuation in which, during construction, the contractor completes odd items or work outside the scope of the works contract as instructed by the employer, valued at the all-in unit rates agreed in the contract, and divided into labour, materials and construction vessels or plant. 3.9 main contractor's attendance

The cost of the services required of the main contractor in cooperating with and coordinating the employer in letting specialist works, and in the site management and completion documentation brought within the scope of the main contract. [GB 50500-2013, definition 2.0.21, modified]

3.10 health, safety and environmental provisions

The costs incurred by the contractor for the corresponding measures taken on the construction site in accordance with national laws, regulations and standards and with the requirements of safe production and civilised construction. [GB 50500-2013, definition 2.0.22, modified]

3.11 unit rate project

An item measured according to the contract drawings, including design variations, and to the measurement rules of the current national measurement codes for the relevant works, and valued against the corresponding all-in unit rate in the priced bill of quantities.
